Palestine Labor Law

 

Working day/week/month:

  • Working week must not exceeds 45 working hours
  • Working week must be at least 5 days and not exceeding 9 hours per day.
  • Working for five hours or more day employee must get break for 1 hour maximum.
  • Week rest must be at least 24 continuous hours
  • For employees in risky works the daily working hours will be reduced by an hour each day.
  • Upon agreement between employer and employee, working for overtime must not exceeds 12 hours a week, and the working day including overtime hours and breaks must not exceeds 12 hours.

An employer must keep a register of hours of work, weekly rest hours, overtime, and overtime and for work on weekly rest, which will register the details prescribed by regulations. Also records for wages paid and salary slips.

Salaries:

  • An employee is entitled to receive wages not less than the minimum daily, hourly or monthly rates established by law. Currently the gross rate is NIS 1,450 per month.
  • An employee is entitled to be paid no later the 5th day of the date the salary is accrued.
  • The overtime worked hours will be paid 150% of regular salary.
  • Working on weekends and holidays (Religious and National Leaves) will be paid 150% of the regular salary.

Annual leave law:

  • According to Palestinian labor law , the employee is entitled to two weeks as paid annual leave, for employees in risky work or who spent over five years within the organization is entitled to three weeks paid annual leave.
  • The annual leaves days could be accumulated up to two years.
  • If the employee did not complete the year, annual leaves will be calculated proportionally.
  • The leave date will be determined according to the arrangement between employer and employee to be suitable for work conditions.

Religious and National Leaves:

An employee is entitled to 13 days religious leave and 3 days as national leaves as following:

  • Al-Fitter -4 days
  • Al-Adha -3 days
  • Christmas -3 days
  • Easter -3 days
  • National day 1/1 – 1 day
  • Labor day – 1 day
  • Independence day -1 day

Sick leave every employee is entitled to 14 days paid sick leave and another 14 days half paid sick leave.

In the cases of death of close relative or second degree relative the employee is entitled to a leave of 3 days.

Educational leave: every employee is entitled to one week leave for educational purposes.

An employee who spent over five years within the organization is entitled to Hajj leave for two weeks for one time.
